Q & A: Expand Your ADA Knowledge

An employee with a psychiatric disability works in a warehouse, stocking shelves. She has no customer contact and does not come into regular contact with other employees. She comes to work disheveled and has become increasingly anti-social. Her work, however, has not suffered. The company handbook states that employees should have a neat appearance at all times and employees should be courteous to each other. If the employer disciplines the employee, would that be a violation of the ADA?

  • Possibly yes, because the dress code and co-worker courtesy rules are not job-related for the position in question and are not based on business necessity.
