Job Bias Charges Approach Record High in Fiscal Year 2009, Equal Employment Opportunity Commission (EEOC) Reports
The U.S. Equal Employment Opportunity Commission (EEOC) announced that 93,277 workplace discrimination charges were filed with the federal agency nationwide during Fiscal Year (FY) 2009, the second highest level ever, and monetary relief obtained for victims totaled over $376 million. The comprehensive enforcement and litigation statistics for FY 2009, which ended Sept. 30, 2009, are posted on the EEOC web site.

Regional Employment Listening Sessions Hosted by Office of Disability Employment Policy (ODEP)

Obama Administration Issues Rules Requiring Parity in Treatment of Mental, Substance Use Disorders
The new rules prohibit group health insurance plans—typically offered by employers—from restricting access to care for mental health or substance use disorders by limiting benefits and requiring higher patient costs than those that apply to general medical or surgical benefits. The rules implement the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA).

New Advertising Campaign Uses Humor to Promote Hiring People with Disabilities
A national effort to encourage businesses to employ workers with disabilities is not your father’s hire the handicapped campaign. A print ad from a new campaign using comical labels, intended to encourage employers to ignore labels when hiring people with disabilities.

Florida Commits to Provide Effective Communication for Deaf and Hard-of-Hearing Persons
The Florida Department of Children and Families (DCF) will provide qualified sign language interpreters as required by federal law to deaf and hard-of-hearing persons using its programs and services across the state under a Settlement Agreement reached with the U.S. Department of Health and Human Services (HHS).

ENFORCEMENT UPDATE: ADA
Justice Department Files for Immediate Relief Regarding Conditions in Georgia’s Hospitals
The Justice Department’s Civil Rights Division has filed a motion for immediate relief to protect individuals confined in seven state-run psychiatric hospitals in Georgia from the imminent and serious threat of harm to their lives, health and safety. The motion, filed January 28, seeks appointment of a monitor who will set binding targets and timetables for reducing the number of residents at the hospitals and expanding appropriate community based services.
Justice Department Settles Lawsuit Alleging HIV Discrimination by RV Resort in Alabama
The Justice Department has settled an Americans with Disabilities Act (ADA) lawsuit against an Alabama RV park that barred a child who was HIV-positive from its swimming pool in 2007.
Justice Department Reaches Three Settlements under the Americans with Disabilities Act Regarding the Use of Electronic Book Readers
The Justice Department announced separate agreements under the Americans with Disabilities Act (ADA) with Case Western Reserve University in Cleveland, [Ohio,] Pace University in New York City and Reed College in Portland, Oregon, regarding the use in a classroom setting of the electronic book reader, the Kindle DX, a hand-held technological device that simulates the experience of reading a book.

Federal Communications Commission (FCC) Enforcement Bureau Takes Action to Enhance Access to Digital Wireless Service for Individuals with Hearing Disabilities
The Federal Communications Commission (FCC) Enforcement Bureau has taken action against several companies for their failure to provide information that helps individuals with hearing disabilities fully utilize wireless phone services – allowing them to communicate effectively on their wireless phones without excessive feedback and noise.

Helping Haitians with Disabilities after the Earthquake
Portlight Strategies is on the ground in Haiti providing food, water and other emergency services to Haitians with disabilities. Healing Hands for Haiti has served Haitians with Disabilities for over 10 years, and despite suffering serious losses of their own, they continue to assist Haitians with disabilities in Port-au-Prince, the capital city.

In December 2009, the percentage of people with disabilities in the labor force was 21.6 compared with 70.0 for persons with no disability. The unemployment rate for those with disabilities was 13.8 percent, compared with 9.5 percent for persons with no disability, not seasonally adjusted.

Building the Legacy: New Training Curriculum on the Individuals with Disabilities Education Act (IDEA)
The training curriculum "Building the Legacy / Construyendo el Legado" was produced by National Dissemination Center for Children with Disabilities (NICHCY) at the request of the Office of Special Education Programs (OSEP) at the U.S. Department of Education. This curriculum is intended to help all those involved with children with disabilities understand and implement the IDEA 2004, the nation's special education law. The training is organized according to five themes central to IDEA (Individuals with Disabilities Education Act), with multiple training modules beneath each theme.

College students with disabilities share strategies they use to succeed in staying in school, graduate and land jobs.
